Acceptable Use Policy

Welcome to the OCR Community! This mailing list service is provided by Oxford Cambridge and RSA Examinations ("OCR") to promote communication, collaboration and the exchange of ideas between teachers, centres, examiners and OCR.

This is the acceptable use policy for OCR. By subscribing or sending a message to any of our lists you are agreeing to comply with these conditions, so please read them carefully. In particular see the sections in bold italic below.

Definitions

"List Member" means a person who subscribes to an OCR Community mailing list. A List Member is entitled to send emails to, receive emails from and view the archive of the OCR Community mailing list(s) to which they subscribe.

"List Owner" means the party who creates and/or manages an OCR Community mailing list.

No Posting of Promotional Messages

The posting of commercial or advertising material is not allowed on any OCR Community mailing list.

However, publicising items of potential interest to List Members, such as publications, training courses, websites, conferences etc. which may be of benefit to the List Members, is permitted provided the following conditions are met:

  • Before sending promotional messages you must seek permission from the List Owner, unless the List Owner or list guidelines have already stated that this type of posting is acceptable.
  • Promotional messages should only be sent if they are relevant to the subject or purpose of that list.
  • Promotional messages must be sent from a clearly identified and contactable source.
  • Such messages must not be part of a commercial exchange. List Owners shall NOT charge for the posting of such messages, nor will OCR forward messages for a fee.

No Spam or Bulk Email

The OCR Community service does not allow unsolicited bulk email, commercial or otherwise, on any OCR Community mailing list. We take the following measures to prevent this abuse of our service.

Anti-spam Measures

  • Most List Members must confirm their subscription. This means that the senders of junk email cannot become a List Member using a forged address.
  • List Owners can configure their lists so messages which are not from List Members are rejected.
  • The OCR Community service uses technology to block much of the junk email (spam) which is posted to the OCR Community mailing lists.

Despite our best efforts, some abuse of the OCR Community service will occur. If junk email is sent to any list please contact your List Owner, who may then notify OCR.

Content of Messages

Sending messages to OCR Community mailing lists is generally a matter of common sense and courtesy. As a List Member you should be able to use your own sense of what is appropriate to guide your conduct, without engaging in unreasonable behaviour, or disrupting the general flow of discussion on a list.

The use of OCR Community services is subject to English laws. Accordingly, you must not send any message which contains any material that is unlawful. This includes, without limitation, any material which is in breach of the intellectual property rights of a third party, which is defamatory, obscene, pornographic or could reasonably be expected to cause offence to any List Member or other third party.

In addition you must not send any message that contains any virus, worm, trojan horse or any other harmful or disruptive component.

OCR does not assume any responsibility for the content of messages sent to any OCR Community mailing list, as the messages are sent by List Members. OCR is not liable for any damage caused by receipt of or reliance upon the contents of a message by a List Member.

You accept that you are solely responsible for the content of any email message you send to any OCR Community mailing list.

Copyright of Messages

When a List Member sends a message to an OCR Community mailing list, they retain their copyright in that message. They also retain their moral right to be identified as the author of the work, and their moral right against derogatory treatment of that message.

You warrant that the use of material contained in any message that you submit to an OCR Community mailing list will not infringe the copyright or other intellectual property right belonging to any third party and you hereby indemnify us and will keep us indemnified against any damages that are awarded to be paid to any such third party following a breach by you of this warranty.

How widely available a message to a particular list will be across the internet will depend on the level of access which has been set by the List Owner.

You give OCR, and where appropriate, the List Owner, permission to reproduce, deliver, distribute and archive your message as appropriate, and you agree that other List Members may read, save, download or print your message.

Message Archives

Messages sent to a list will normally be archived, and these archives can then be read or downloaded by any member of that same list. These archives may also (at the discretion of the List Owner) be made publicly available on the internet, and thus be available to anyone.

If the List Owner has made the archives available on the internet, then List Members permit such use by third parties as is permitted by the List Owner in respect of that OCR Community mailing list.

When using any OCR Community mailing lists, you acknowledge and accept that any message you post to an OCR Community mailing list may be archived in this manner, and that other List Members may download and print these messages for their own use.

Archives or collections of the messages sent to an OCR Community mailing list may not be made publicly available at another site unless the List Owner has granted explicit permission, and current List Members of the relevant list have been informed.

Security of Email Messages

Due to the nature of the internet, the security of messages to OCR Community mailing lists cannot be guaranteed, and you should bear this in mind when posting confidential information to an OCR Community mailing list. This is true even when access to the list is restricted.

Information about OCR Community mailing lists

When you subscribe to an OCR Community mailing list you supply us with your email address, and this information can be retrieved by any List Member of that list and may also (at the discretion of the List Owner) be made available on the internet.

As a List Member, you consent to (at the discretion of the List Owner) your email address being made available in any country outside the European Union via the internet.

When you leave OCR's Community mailing list service, your email address will be removed from our database. However, any message you have posted to an OCR Community mailing list will remain in the OCR archives and may also (at the discretion of the List Owner) remain available on the internet.

The personal information we hold will only be used in connection with the OCR Community service. OCR will never sell email addresses, or any other personal information, to another organisation.

You agree that OCR may disclose your personal information if we believe that this is necessary to operate our systems, to run the OCR Community service, to comply with the law, or to protect OCR.

Forging Information

You will not attempt to mislead others as to your identity, either by providing false information when subscribing to, or posting to, an OCR Community mailing list, or by forging the headers and addresses in an email message.

Harvesting Addresses

You shall not use the OCR Community service to bulk harvest, or otherwise collect, information about others, including email addresses, without their consent.

OCR has implemented technology to limit access by the mass mailers which collect email addresses.

Violation of our Policy

List Members may contact us about any act that they reasonably believe to be a breach of our acceptable use policy, and we will take any of the following actions if it is thought appropriate:
  • Remove, whether temporarily or permanently, any OCR Community mailing list
  • Contact the person responsible to discuss the problem
  • Contact their listowner
  • Remove them from the list membership
  • Contact their hosting site, institution, or service provider
  • Restrict email from certain sites or addresses
  • Remove inappropriate messages from the OCR Community archives
  • Make a public announcement to those affected

List Owners are also entitled to take such action as they believe reasonable against any List Member who engages in unreasonable behaviour. List Owners may introduce their own policies in addition to those listed here. By subscribing to that OCR Community mailing list, you agree to comply with these policies.

The decision on what action is appropriate will be made by the OCR Community team on a case by case basis. The action taken will often depend on whether the infraction was innocent, inadvertent or intentional.

If we receive any complaint about a message sent to an OCR Community mailing list, we reserve the right to remove the message from our archives immediately and without consulting the List Member responsible or the List Owner of the relevant OCR Community mailing list.

Liability

OCR is not liable for any losses or damages caused by a failure of the system. OCR is also not liable for the conduct of any List Member.

Amendments

OCR reserves the right to amend the acceptable use policy at any time without notice. If the policy is amended then all List Owners will be informed and may distribute the information to List Members.

Availability

OCR will use all reasonable endeavours to ensure that each OCR Community mailing list is permanently available, but OCR makes no representation that each mailing list will always be available and you acknowledge and agree that OCR is not liable for any temporary or permanent unavailability of that mailing list.

Termination

List Members acknowledge and agree that OCR may terminate your subscription for any reason, with or without notice. You may also terminate your subscription at any time.
